Terms of service

01Agreement

These terms are between you and Nexzena LLC, a limited liability company registered in Texas, United States ("Nexzena", "we", "us"). They cover this website and any Nexzena product you use, including Thrivync. By creating an account or using a product, you accept them. If you don't, don't use the products.

02Your account

• You must be at least 13 years old. If you are under 18, you need a parent or guardian to review and agree to these terms with you.
• Keep your login credentials to yourself. Activity under your account is your responsibility.
• One account per person. Don't share, resell, or transfer access.
• Tell us promptly at nexzenallc@gmail.com if you think your account has been compromised.

03Acceptable use

Don't do any of the following with our products:

• Break the law, infringe someone's rights, or harass anyone.
• Attempt to breach, overload, scrape at scale, or reverse-engineer the service.
• Resell the service, or use it to build a competing product from our outputs.
• Upload malware, or content you have no right to upload.

We can suspend or close accounts that do these things, with notice where practical.

04Your content

What you create in our products stays yours. You grant us only the licence we need to host, back up, process, and display it back to you — nothing more. We don't publish your content, and we don't use it to advertise.

05Generated content

Some of our products generate material for you using AI models. Generated output can be wrong, incomplete, or out of date, and it is not professional, medical, legal, or financial advice. Check anything that matters before you rely on it. Similar prompts may produce similar output for other users, so we make no claim of exclusivity in generated material.

06Wellness features are not medical care

Thrivync includes mood check-ins, sleep logging, stress tools, and burnout-risk signals. These are self-help and self-tracking features. They are not medical or mental-health treatment, they are not a diagnosis, and Nexzena is not a healthcare provider.

Do not use them in place of professional care. If you are in crisis or thinking about harming yourself, contact your local emergency number or a crisis line — in the US, call or text 988 — rather than the app.

07Subscriptions and payment

• Paid plans renew automatically — monthly or annually — until you cancel.
• You can cancel any time from your account settings, or through the App Store or Google Play if you subscribed there. Cancellation stops the next renewal; access continues to the end of the period you already paid for.
• Prices are in US dollars and exclude tax where tax applies.
• We may change prices with at least 30 days' notice before your next renewal.
• Refunds. Payments are generally non-refundable, but if something goes wrong, email us — we'd rather sort it out than argue. Purchases made through the App Store or Google Play are refunded under their policies, not ours.

08Availability

We aim to keep the service running, but we don't guarantee uninterrupted access. Maintenance, outages, and dependency failures happen. We may change or discontinue features; if we discontinue a paid product outright, we'll give notice and refund any unused prepaid time.

09Our rights

The software, design, branding, and content of the service belong to Nexzena LLC or our licensors. These terms grant you a personal, non-exclusive, non-transferable right to use the service — not ownership of it.

10Disclaimer and liability

The service is provided "as is" and "as available", without warranties of any kind to the fullest extent the law allows. To the extent permitted by law, Nexzena LLC is not liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose. Some jurisdictions don't allow these limits, in which case they apply to you only as far as the law permits.

11Termination

You can close your account at any time. We can suspend or terminate access for a breach of these terms, or if required by law. On termination, your right to use the service ends; sections that by their nature should survive — ownership, disclaimers, liability — do.

12Governing law

These terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules. Disputes go to the state or federal courts located in Texas, unless mandatory consumer-protection law in your country of residence gives you the right to sue elsewhere.

13Changes

We may update these terms. Material changes are announced by email or in-product before they take effect, and the date above is updated. Continuing to use the service after that means you accept the new terms.
